This name should be instantly recognisable due to the coverage and exposure that was shed upon it in October 2017. It was during this month that a massive data breach was exposed and highlighted the importance of the Bill that was still to be passed, the Protection of Personal Information Act 4 of 2013 (“the Act”) which aims to secure the protection of personal information that is processed by both private and public bodies.
With the Act coming into effect on 1st July 2020, Companies will now have to ensure that they are compliant, as the Act introduces certain requirements when processing personal information and under what conditions, this may be done.
The Act seeks to establish an Information Regulator which contains powers and a mandate to exercise duties, powers and perform functions, such as an ombudsman. It further aims to provide for the issuing of codes of conduct, the rights of persons regarding unsolicited electronic communications and automated decision making and the protection of personal information of individuals.
